At 0205 hours on 4/19/14, Oxnard Police Officers responded reference a domestic battery that had just occurred in the 1400 block of Lyonia Lane. Officers learned that the parties involved were now at a residence in the 1400 block of Halesia Lane. Officers heard a female crying inside, but the occupants refused to answer the front door. Officers forced the front door open to check the well-being of the female. The suspect, Jesus Pena, was located inside the residence. Officers determined that an altercation had occurred and the victim was battered. Pena was arrested for domestic violence and violating his Post Release Offender status.
Pena is currently in the Post Release Offender Program, created by Assembly Bill 109 – the 2011 Public Safety Realignment – which was effective October 1, 2011. This program mandates that individuals sentenced to non-violent, non-serious (irrespective of priors) or non-sex offenses will serve their sentences in county jails instead of state prison. The public should be aware that release under AB 109 is based on the offender’s most recent committing offense. Prior convictions arenot considered.
