DETAILS:
On 1/17/14 at approximately 2205 hours, an Oxnard Police Department Officer attempted to conduct a traffic stop in the area of Ventura Road and Fifth Street. The vehicle attempted to evade the officer and sped off at a high rate of speed after a loaded .25 caliber handgun was thrown from the vehicle. A vehicle pursuit ensued which lasted approximately 2 minutes.
During the pursuit, the driver of the vehicle, Lewis Avalos, began driving erratically, which included failing to stop at red lights, and speeding, all in an attempt to evade the officer.
The pursuit was discontinued in the area of Fifth Street and Harbor Blvd when speeds reached 95 mph entering a residential neighborhood. The vehicle was found abandoned a few blocks away and both Avalos and the passenger, George Martinez were taken into custody without incident.
Avalos was arrested for felony evading, violation of probation, and violation of a gang injunction. Martinez was arrested for an outstanding felony warrant. Both suspects were booked into Ventura County Jail.
Avalos and Martinez are both currently in the Post Release Offender Program, created by Assembly Bill 109 – the 2011 Public Safety Realignment – which was effective October 1, 2011. This program mandates that individuals sentenced to non-violent, non-serious (irrespective of priors) or non-sex offenses will serve their sentences in county jails instead of state prison. The public should be aware that release under AB 109 is based on the offender’s most recent committing offense. Prior convictions arenot considered.
