DETAILS:
On November 6, 2012, at approximately 1430 hours, officers from the Special Enforcement Unit attempted to contact a suspicious subject in the area of Camino Del La Luna and Olivia. When officers approached the suspect, he fled and a short foot pursuit ensued. As the officers caught the suspect, he attempted to strike one of them. He was ultimately subdued after a brief struggle and the use of a Taser.

Suspect Basquez was arrested for possession of narcotics paraphernalia, providing false information to an officer, delaying a peace officer’s duties and resisting arrest by force.

Bobby Basquez was on the Post Release Offender (PRO) program. The PRO Program released non-violent, non-sexual and non-serious offenders from prison pursuant to Assembly Bill 109.

DETAILS:

On November 10, 2012 at approximately 1350 hours, officers were dispatched to the 700 block of Teakwood regarding a stabbing. When officers arrived they contacted a victim who had sustained stab wound to his back. The victim was transported to Ventura County Medical Center where he is listed in stable condition.

Officers located another victim, who had sustained a laceration to his head, in the 3000 block of South “G” Street. He was transported to Saint John’s Regional Medical Center for his injuries and later released.

During the investigation it was revealed that both subjects confronted each other and a fight ensued. During the course of the fight, one of the subjects was stabbed and the other subject was hit in the head with an unknown type object. The motive for the attack is unknown but it doesn’t appear to be gang related.

DETAILS:

On 1-8-13, at 1455 hours, an Oxnard Police Department officer and a Ventura County Probation Department officer went to an upstairs apartment in the 4800 Block of Terrace Avenue to serve a felony PRO warrant. The suspect was identified as Teodulo Duran.

During the attempted arrest a struggle ensued. Duran and the two officers fell down an outside stairs. All three sustained minor to moderate injuries that required medical attention at local hospitals. Duran was arrested and found to be in possession of narcotics.

Duran was booked into the Ventura County Main Jail for the PRO warrant with the additional charges of resisting arrest, battery on a police officer(s), possession of controlled substances for sale, and possession of a narcotics smoking device being alleged.

An investigation is continuing.

DETAILS:

On 1-19-13 at about 2326 hours, Oxnard Police Officers responded to the McDonalds located in the 400 block of South Ventura Road reference a possible kidnapping that had just occurred.

When officers arrived they learned from several witnesses that a male in his 30s appeared to be arguing with a female in her 30s just outside the McDonalds. At some point witnesses saw the male grab the female and force her into a white SUV.

The SUV was described as a late 1990s to early 2000s white Ford Explorer with tan fenders and lower door panels, stock chrome rims and tinted windows. At this time it is unknown if this was a domestic violence incident or whether this was an actual kidnapping. Video surveillance footage was obtained. Attached are still photographs of the suspect vehicle and the male suspect. The investigation is ongoing.

The Oxnard Police Department conducted a joint operation with the State of California, Department of Motor Vehicles regarding illegal vehicle sales. This operation resulted in the arrest of two men who were selling vehicles that were not registered to them and unlawful dealer activity.

Over the last 2 months The Oxnard Police Department received several complaints from downtown business owners and residents regarding suspected unlawful vehicle sales. In one area there were so many cars parked for sale, no parking was available for customers of the retail spaces. Area merchants noticed the same people moving cars around that were for sale and suspected they were unlawful vehicle dealers. The Oxnard Police Department compiled data over a 6 week period and identified several suspected vehicle dealers unlawfully engaged in vehicle sales on city streets. Several locations were identified due to an unusually high number of cars parked for sale on a daily basis. This activity was an indication that a vehicle dealer may be posing as a private party to sell vehicles to avoid registration fees and taxes. The OPD and DMV used undercover personnel to negotiate vehicle sales with two different men who had multiple cars parked for sale in Oxnard.

Both men had numerous vehicles for sale and admitted that they were selling multiple vehicles. Joaquin Samano had three cars for sale at various street corners. Ernesto Macias had four to six cars parked for sale in downtown. Further investigation revealed Macias was in possession of 10 other vehicle titles and 10 different sets of vehicle keys. Both suspects were arrested and we are continuing to investigate additional leads regarding unlawful vehicle sales in the Oxnard area.

The Oxnard Police Department would like to educate the public and remind you that private parties are allowed to sell their own vehicles but they may not engage in the vehicle sales business without being properly licensed and bonded. If a person buys cars for the purpose of resale they must obtain a vehicle dealer license from the State of California and follow the strict guidelines for licensing and resale. Vehicle sales are tightly regulated by the State of California and it is unlawful for someone to sell a vehicle that is not registered to them without written authority such as a legal power of attorney. The suspects in this case appear to have been “flipping” cars by purchasing a car for one price then reselling or “flipping” it for a profit without being properly licensed.

TERMS, FACTS and TIPS:

Curbstoning is the repeated, unlicensed “flipping” of used cars for profit.
Curbstoners are people who actively and regularly buy and sell vehicles without a license, proper permits or a legally established place of business and who, many times, represent themselves as private sellers in order to attract buyers.

Nuisance: Curbstoners often turn high traffic areas into instant parking lots, lining up cars at gas stations, supermarkets, convenience stores, on private property or even the side of the road. They deprive shoppers of places to park and the inconvenience and unsightliness drives away business.
Fraud: Consumers can easily become victims of fraud involving issues like Odometer Tampering, Undisclosed Frame Damage or Salvage Rebuilt Vehicles, Faulty Safety Devices, Mechanics or Promissory Liens and other problems that may not be truthfully disclosed at the time of sale. A consumer has no recourse!

Criminal: The most common crime committed by Curbstoners is Tax Fraud. When an unsuspecting customer buys a car, the curbstoner will leave the title blank or “open.” Without the curb stoner’s name on the document, they are able to pocket the money (usually cash) and avoid paying State Sales Tax, Federal Income Tax and any other declarations that are legally required.

PROTECT YOUSELF!

Be suspicious of cars and vehicles suddenly parked in undesignated areas.
Monitor free advertising sites, like Craigslist, for cases in which the same contact phone number appears on various private-party listings.
Compare contact information on ‘For Sale’ signs to see if it is the same.
Verify the name on the Certificate of Ownership (title) matches the seller’s name.
Steer away from sellers who accept only cash and refuse checks or money orders.
A curbstoner will not let you have the vehicle independently inspected or provide maintenance records that match the car.
A curbstoner will not allow you to conduct a CarFax report because it will detail if the vehicle was sold at auction.

On 5/25/13, at approximately 6:09 P.M., officers from the Oxnard Police Department were dispatched to the area of ‘J’ Street and Kamala Street in reference to a reported road rage incident involving a brandishing of a handgun. The suspect vehicle was described as a red, convertible Ford Mustang.

When responding officers arrived on scene, the Ford Mustang was located as it was traveling northbound on ‘J’ Street with two occupants. The Mustang was stopped after traveling a short distance and the occupants were detained. During a search of the vehicle, a loaded handgun was found under the driver’s seat. The driver, Jesus Ortiz, was arrested for weapons violations including being a convicted felon in possession of a firearm. He was booked into Ventura County Jail. The passenger was released from the scene.

On 06/10/2013, Oxnard Police Department Officers were dispatched to a call of a possible armed robbery which occurred in the west alley of 1135 North G Street. Upon officer arrival, two male suspects matching the description given by the victim and witnesses were seen running into a nearby apartment complex. After a brief search, suspects were located hiding on the roof of the apartment complex at 1043 North G Street. The suspects were taken into custody without incident.

It was determined that both suspects attempted to force entry into the victim’s vehicle. It was believed that one of the suspects was armed with a handgun. The victim, in fear for her safety, fled the location prior to the suspects gaining entry into her vehicle. Both suspects were positively identified by the victim and witnesses.

On 07/11/2013 at 0807 hours, Oxnard Police Officer observed the suspect vehicle in the 200 block of North Juanita Avenue. The vehicle was stopped for traffic violations. The officer contacted the driver, Christian Hernandez, a 24-year old resident of Oxnard.

The officer observed narcotic paraphernalia on the seat next to the suspect as well a 3-year old child that was unrestrained in the back seat. The officer arrested Hernandez and the child was released to the mother. During the arrest, officers located burglary tools used to tamper with vehicles and to commit auto theft.

On August 11, 2013, at approximately 1026 hours, an Oxnard Police Department officer attempted to conduct a traffic stop on a Ford pick-up for a vehicle code violation. The driver, Jess Gonzalez, 28 years old of Oxnard, led officers on a two minute, two-mile pursuit over city streets. Gonzalez committed numerous Vehicle Code violations while being pursued. During the pursuit, Gonzalez failed to negotiate a turn at the intersection of “E” Street and Ninth Street and collided into a black Infiniti that was stopped at the intersection. The vehicle then collided into a residence in the 900 block of South “E” Street. Gonzalez fled from the collision and led officers on a short foot pursuit and was apprehended in the 900 block of South “F” Street.

The driver of the Infinity, Lorenzo Avila, 49 years old of Oxnard, sustained minor injuries and was transported to the Ventura County Medical Center. He was treated and released. Danielle Everett, a passenger in Gonzalez’ vehicle, sustained minor injuries and was transported to Saint John’s Regional Medical Center. No one in the residence was injured nor was Gonzalez.

Gonzalez was arrested for felony evading and felony hit and run. His passenger was not arrested.

DETAILS: On August 15, 2013 at approximately 2:00 P.M, Detectives from the Oxnard Police Department’s Major Crimes Unit arrested 20 year old Carlos Eduardo Hernandez of Oxnard for the murder of Edwin Herrera. Hernandez was later booked into Ventura County Jail for murder. Hernandez’s bail is set at $4,000,000.

Herrera’s murder occurred in the 2000 block of San Benito Street, on February 29, 2012. Members of the Oxnard Police Department’s Major Crimes Unit have been actively investigating this murder since the night it happened. Investigators suspect that the crime was gang motivated but don’t believe the victim was a gang member. Oxnard Police are continuing to investigate this crime and additional arrests are likely. In addition to this arrest, the Oxnard Police Department’s task force, that was formed to address several unsolved homicides in the Lemonwood neighborhood over the last several years, has made arrests on four additional homicide cases.
