On 9/13/19, at about 9:04 p.m., officers attempted to detain suspect Jose Magallanes, age 34, in the 3500 block of Las Tunas Place, for a Vehicle Code violation. Magallanes refused to comply with the officers’ orders to stop and began to flee on his bicycle southbound on Las Tunas Place before falling off of it. Magallanes got back to his feet and began running northbound on Las Tunas Place. As officers pursued Magallanes on foot, he was reaching into his waistband. Officers tackled Magallanes and he continued to physically resist the officers’ efforts to take him into custody. During the physical confrontation with the officers, Magallanes discarded a loaded handgun which was later determined to be stolen. Both officers involved in the physical struggle sustained minor injuries, but did not require hospitalization. Officers subsequently searched Magallanes and located a small quantity of a controlled substance on his person.

Magallanes has a history of violence, is a convicted felon, and is prohibited from possessing a firearm.

Magallanes was charged with the following felony offenses: carrying a loaded firearm in public, felon in possession of a firearm, possession of a controlled substance with a firearm, and violently resisting officers. Additionally, he was arrested for an outstanding misdemeanor warrant.

On September 11, 2019, at approximately 11:36 p.m., officers from the Oxnard Police Department and EMS personnel responded to a traffic collision involving a pedestrian on Ventura Rd. near the intersection of Juniper St.

A 37-year-old female was located in the roadway and pronounced deceased at the scene. The name of the pedestrian is being withheld pending notification to the family.

During the investigation, officers determined that the female victim had been walking in the northbound lanes of Ventura Rd. and was struck by a dark-colored SUV. After hitting the victim, the driver of the SUV fled.

According to witnesses, the victim may have been struck by several additional vehicles, all of which fled the scene.

It is unknown whether alcohol or drugs were involved in the collision and the investigation is ongoing.

On 09/10/2019 at approximately 6:38 p.m., Officers with the Oxnard Police Department were dispatched to the west alley of the 2100 block of Mariposa Street in reference to a stabbing victim. Upon arrival, officers located a 51 year old Oxnard resident who had been stabbed. The victim was transported to a local hospital. His wounds were not life threatening and the investigation is ongoing.

On 09/9/2019 at about 8:20PM, Oxnard police officers were called to the 1000 block of Quail Run Way regarding a female passed out in a vehicle. Once on scene officers contacted Davis and, through an investigation, arrested her for being under the influence of a controlled substance. Officers located several items of contraband in Davis’ vehicle, including burglary tools, stolen property (financial documents and medication), methamphetamine, and drug paraphernalia. Additionally, officers also located a shotgun in the vehicle. Davis is a convicted felon and prohibited from possessing firearms.

Davis was arrested for multiple narcotics violations (being under the influence of a controlled substance, possession of a controlled substance, and possession of drug paraphernalia), possession of burglary tools and stolen property, and possession of a firearm by a prohibited person.

The Oxnard Police Department encourages drivers and riders to share the road

The Oxnard Police Department will have extra officers out on patrol Saturday, September 7, 2019, between 12:00 p.m. to 5:00 p.m. looking for violations made by drivers and motorcyclists that increase the risk of crashes.

The motorcycle safety enforcement operation aims at educating both motorcyclists and drivers on the rules of the road.

Motorcycle fatalities have jumped dramatically in California over the past decade. In 2017, there were 576 people killed in motorcycle crashes statewide, up nearly 17 percent from 494 in 2015. Over the course of the past three years, motorcycle-involved collisions have resulted in five fatal and 93 injury crashes in Oxnard alone.

Drivers should be alert for motorcyclists, as many motorcycle crashes are caused when drivers do not see them. Check your mirrors and blind spots, especially when merging, turning, or changing lanes.

Riders should make themselves visible by wearing brightly colored, protective clothing and keeping lights on during the day. Riders should also change lanes only when there is enough room and always wear a Department of Transportation compliant helmet.

Although lane splitting is now legal, motorcyclists should be extra careful traveling between lanes, avoiding the practice of riding next to large vehicles like big rigs, buses, and motorhomes and factoring in lane width, traffic flow, and roadway conditions.

On 09/03/2019 at approximately 6:44 p.m., Officers with the Oxnard Police Department were dispatched to the parking lot of the Tresierra’s Market, located at 133 West Pleasant Valley Road reference a fight in the parking lot. Officers arrived on scene and all parties were gone. A 27 year old male victim later showed up a local area hospital with multiple stab wounds. The victim is currently listed in critical condition. The investigation is ongoing.

On September 3, at 5:50 p.m., officers from the Special Enforcement Unit (gang unit) conducted a traffic enforcement stop to a vehicle for an observed vehicle code violation. Officers contacted the occupants of the vehicle and obtained their information. It was found that the passenger, Jesus Negrete, was on searchable probation for firearms violations and gang terms.

Negrete was detained at the scene while officers responded to his residence for the purposes of conducting a probation search. During the probation search, officers located a 9mm handgun that was unregistered along with ammunition. Further evidence found during the investigation linked Negrete to the firearm and ammunition.

Negrete was arrested for multiple felonies that include 29800(a)(1) P.C- Felon in possession of a firearm, 29815(a) P.C- Subject on probation and prohibited from possessing a firearm and 30305(a)(1) P.C- Possession of ammunition by a prohibited person.

DUI Checkpoint nets one DUI arrest

The Oxnard Police Department Traffic Unit arrested one impaired driver while conducting a DUI/Driver’s license checkpoint on August 30, 2019. The checkpoint was conducted on Gonzales Road west of Snow Avenue between the hours of 8:00 p.m. and 2:00 a.m., resulting in the following:

536 vehicles screened
One DUI-alcohol suspect arrested
Eight drivers cited for operating a vehicle unlicensed or while suspended/revoked
20 citations issued

Checkpoints are placed in locations that have the greatest opportunity for achieving drunk and drugged driving deterrence and provide the greatest safety for officers and the public.

In recent years, California has seen a disturbing increase in drug-impaired driving crashes. Oxnard PD supports the new effort from the Office of Traffic Safety that aims to educate all drivers that “DUI Doesn’t Just Mean Booze.” If you take prescription drugs, particularly those with a driving or operating machinery warning on the label, you might be impaired enough to get a DUI. Marijuana can also be impairing, especially in combination with alcohol or other drugs, and can result in a DUI.

Studies of California drivers have shown that 30 percent of drivers in fatal crashes had one or more drugs in their systems. A study of active drivers showed more tested positive for drugs that may impair driving (14 percent) than did for alcohol (7.3 percent). Of the drugs, marijuana was most prevalent, at 7.4 percent, slightly more than alcohol.

Oxnard PD offers these reminders to ensure a fun night doesn’t get spoiled with a DUI:

Decide before you go out whether you plan to drink or drive. You can’t do both.
If you plan to drink, designate a sober driver before going out, or map out another way to get home safely by taking a cab, ride-share services like Uber or Lyft, or using public transportation. You can also lookup designated driver services in your area using the National Directory of Designated Driver Services (NDDDS).
If you are a designated driver, bars and restaurants statewide have created non-alcoholic specialty drinks (“DDrinks”) for sober drivers: http://bit.ly/OTSDDrinks
If you happen to see a drunk driver on the road, call 911. Offer a description of the vehicle, location, and direction of travel.
See your friend or other patron impaired trying to get behind the wheel? Take the keys or help them make other arrangements to get where they are going safely.

Drivers caught driving impaired and charged with DUI can expect the impact of a DUI arrest to be approximately $13,500. This includes fines, fees, DUI classes, license suspension, and other expenses not to mention possible jail time.

UPDATE:

At the beginning of the investigation, Mr. Villarreal was identified as the shooter by witnesses inside the residence. After conducting a thorough investigation, Mr. Villarreal was arrested for the murder of the victim. Mr. Villarreal was booked into the Ventura County Jail on a bail amount of $500,000.

DETAILS:

On August 30, 2019, at about 11:30 P.M., patrol officers from the Oxnard Police Department and Emergency Medical Services (EMS) responded to the 1000 block of Berkshire Street for a report of a subject with a gunshot wound. This was the second call for service to this location that night for a family dispute.

When officers arrived, they located a 40-year-old Hispanic male with a wound to his chest. Patrol officers began providing life-saving measures until it was safe for EMS to enter the scene. Despite the heroic efforts of the officers and EMS, the victim died at the scene. Patrol officers contacted and detained the suspected shooter, Jaime Villarreal without incident. The investigation is continuing.

DATE/TIME PREPARED: 8/31/19, 3:30 a.m.

On August 25, 2019, at approximately 1:03 p.m., officers from the Oxnard Police Department and EMS personnel responded to a traffic collision which occurred on Gonzales Road at Patterson Road. Officers discovered that a 2005 Dodge Caravan and a specially constructed Volkswagen dune buggy had collided at the intersection. The driver of the dune buggy was partially ejected from the vehicle and was immediately transported to the Ventura County Medical Center where she is listed in critical condition. The passenger of the dune buggy, a 40-year-old male of Oxnard, and driver of the Dodge Caravan, an 18-year-old male of Oxnard, sustained moderate injuries and were transported to the hospital for treatment.

Based on the preliminary investigation, traffic investigators determined the Dodge Caravan was traveling eastbound on Gonzales Road and the dune buggy was traveling northbound on Patterson Road. Both vehicles entered the intersection at the same time and were involved in a broadside type collision. The traffic control signal was functioning properly at the time of the collision and it is unclear who had the right of way as one of the vehicles may have failed to stop for a red light.
