On 01-05-2011 at 5:41 A.M. Officers received a call of a vehicle struck by a train at the Wagon Wheel railroad crossing. Upon officer’s arrival to the location, it was discovered that Oxnard resident Marcos Sotelo age 19, attempted to drive his 1991 Jeep Cherokee across the railroad tracks and became stuck on the tracks. Sotelo was able to escape the vehicle, just prior to his vehicle being struck by a southbound Metro-Link train, traveling at an estimated speed of 50 MPH. Sotelo’s vehicle was pushed for a distance of 150 Yards. Sotelo and the nine Metro-Link passengers were uninjured in the crash. The Metro-Link was delayed for approximately two hours. Sotelo was arrested for trespassing on railroad property and transported to the Oxnard Police department for questioning.
The public is reminded that, trespassing on railroad property is a misdemeanor and is punishable by Jail or Fine. Railroad property is defined as; land owned, leased, or possessed by a railroad upon which is placed a railroad track and the land immediately adjacent thereto, to the distance of 20 feet on either side of the track.
